The Tyranny of the Executive Branch FEATURED

 

Populist #21

An honest and logical study of the executive branch will show even the most casual observer that it has always been a source of the People's oppression; from its support of slavery, to its extra-judicial impositions in the war on drugs and the poorly-named war on terror. 

It is the principal evil we face today, and in the future.

It is a widely accepted maxim that history will most often repeat itself; thus, it is reasonable to conclude that many of the acts of depravity brought upon us by the presidency, in the past, will reappear, or in the case of its current wrongdoings, simply continue. 

It has launched unjust and extra-constitutional wars against nations and people who have never done us harm; resulting in the deaths of millions of people.  It has sunk our national dignity and credit to extreme levels.  It has repeatedly violated our rights, spied on us, and lied to us.

Can Republics and Democracies really co-exist?  

A libertarian perspective on Initiative and Referendum (I&R)

We all know that the Constitution was created to define what the Federal government could do and the Bill of Rights defined what they could not.  I believe by and large that the Founding Fathers (at least the Anti-Federalists) believed that it would be enough to define THE ONLY THINGS that they could do.  But it didn't last long.  Starting with the Second Continental Congress, cases like Marbury vs Madison, right up to today's Supreme Court defining the "Spirit" of the Constitution, the Republic has been beat down and turned into the whipping boy of a tyrannical oligarchy.  But were we really surprised?  When asked "What hath ye wrought?" Ben Franklin stated: "A Republic, if you can keep it!"

We didn't keep it.  We assumed it would keep itself.  Few realize it now, but the days of the Republic have long-since come and gone.  If more realized it, we'd be in the middle of another Revolution.  This time the Revolution would not be "Between the States," but between the people and the government.

However, there is hope.  Ol' Ben was right.  We can keep it.  If we start now.

It is unrealistic and impossible to expect a government to abide by the strict letter of the Constitution.  Doing so is choosing to be condemned to the very history our founding fathers fought to change.  I guess they just hoped for the best.  Had they known that the true nature of government is power, they might have thought differently, or fought harder to limit that power.

Focus on the 10th Amendment

"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved for the States respectively, or to the people."

The 10th Amendment makes it plainly clear that the US Federal Government is limited to powers granted to it in the Constitution, and nothing else.

The 10th is an important pillar of our most basic rights.  But, it no longer carries the Constitutional power it was specifically written for - to keep the government from expanding beyond control.

The rapid decline of this amendment began in the FDR years.  Many of the expansions of federal power that were part of the first phase of FDR's New Deal were struck down as unconstitutional by the Supreme Court.

In response, Roosevelt threatened to "pack the court" with judges sympathetic to his causes.  The Supremes quickly backed down, and since then, the authority of the federal government has been widely broadened.

No attempts to repeal the 10th have been made, yet the government doesn't abide by it.  The Populist Party demands a strict adherence to the law.
