In his new book, The Constitution in Exile, Judge Andrew Napolitano explains, quite clearly, that the biggest special interest group in our nation is the federal government itself. The subtitle says it best; that the federal government has "seized power by rewriting the supreme law of the land."
Napolitano makes it the purpose of his book to tell "the unhappy story of liberty lost, federalism trampled, and big government run amok," and makes a strong case for this, indeed.
After taking time to give a clear explanation of each part of the Constitution, he then discusses how our rights were under attack right from the start. People like Alexander Hamilton did everything they could to undermine the new Constitution, and many presidents have done the same ever since.
In what might be the judge's greatest observation, he points out that the famous Marbury v. Madison case gave the federal judiciary the power to rule on the constitutionality of both statutory law and the actions of the executive. "This means that the Supreme Court granted itself the authority to declare the will of the people...null and void..." This has obviously caused us many problems over the years.
By far the best chapter of The Constitution in Exile is number four, "Dishonest Abe: The Lincoln You Didn't Know." which will be an eye-opener to many. But, it's the recommendations on how to fix the problems we face that make the book a must read; abolition of the income tax, a recognition that the federal government should never be a check on its own power, and much more.
Although we rarely make such recommendations, this book is head and shoulders above the rest. |

Your line of reasoning reduces to appealing to your past failures to justify further ones. Because the first troop was sacrificed then 'n' number of troops must be sacrificed until it reaches a state of "worth", defined by the person ordering the sacrifices. Some of the greatest, and most common, violations of the Constitution are directed at the 10th Amendment. This amendment made it explicit that the federal government is limited only to the powers specifically given to it in the Constitution. No more, no less. Period. This means that the federal government doesn't have the power to wage the drug war, invade another nation without a declaration of war from Congress, search us at airports without probable cause, or give away billions of dollars of our money as "foreign aid"
The 10th is plainly written: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
Although it's nearly impossible to keep up with daily violations of this amendment, we do post articles that are of interest on a regular basis. We urge you to visit this section regulary, and send us articles that you feel are important to the 10th amendment. Simply use the form here.
